Terms and Conditions for Elegantly Engraved

Welcome to Elegantly Engraved. By placing an order with us, you agree to the following Terms and Conditions. Please read them carefully before using our services.

1. General 

1.1 These Terms and Conditions govern all orders placed with [Your Laser Engraving Business Name] ("we," "us," or "our") for custom laser engraving services and related products. 

1.2 By submitting an order, you ("the Customer" or "you") agree to be bound by these Terms and Conditions. 

1.3 We reserve the right to update or modify these Terms and Conditions at any time without prior notice. The version in effect at the time of your order will apply.

2. Order Process

2.1 All orders must be submitted through our designated ordering process, which may include our website, email, or in-person consultation. 

2.2 Customers are responsible for providing accurate and complete information, including design specifications, materials, and personalization details. 

2.3 We reserve the right to refuse any order at our discretion, including but not limited to orders with inappropriate, offensive, or copyrighted content without proper authorization. 

2.4 Once an order is submitted and accepted, it is considered final. Changes or cancellations may not be possible due to the custom nature of our products.

3. Custom Products

3.1 All products are custom-made based on the specifications provided by the Customer. As such, we do not accept returns or exchanges unless the product is defective or does not meet the agreed-upon specifications. 

3.2 Customers are responsible for reviewing and approving all proofs, designs, or mock-ups before production begins. Once approved, we are not liable for errors or dissatisfaction related to the approved design.

4. Pricing and Payment

4.1 Prices are quoted at the time of order and are subject to change without notice for future orders. 

4.2 Full payment is required before production begins unless otherwise agreed in writing. 

4.3 We accept payments via credit/debit cards, PayPal, bank transfer. 

4.4 All prices are exclusive of applicable taxes, shipping, or handling fees unless otherwise stated.

5. Production and Turnaround Time

5.1 Production timelines are estimates and not guaranteed. Delays may occur due to material availability, equipment issues, or other unforeseen circumstances. 

5.2 We will communicate any significant delays, but we are not liable for losses or damages caused by delays. 

5.3 Rush orders may be available at an additional cost, subject to our discretion and availability.

6. Shipping and Delivery

6.1 Shipping costs and methods will be provided at the time of order. We are not responsible for delays caused by shipping carriers. 

6.2 Risk of loss or damage passes to the Customer upon delivery to the shipping carrier. 

6.3 Customers are responsible for providing accurate shipping information. Additional costs incurred due to incorrect addresses or failed delivery attempts will be borne by the Customer.

7. Refund Policy

7.1 Due to the custom-made nature of our products, all sales are final, and we do not accept returns or offer refunds except in cases of defective products or errors on our part. 

7.2 If a product is defective or does not meet the agreed-upon specifications, please contact us within 7 days of receipt to report the issue. We may request photos or return of the item for inspection. 

7.3 If approved, we will provide a replacement or repair at no additional cost. Refunds will only be issued if a replacement or repair is not feasible.

8. Intellectual Property

8.1 Customers warrant that any designs, logos, text, or other materials provided for engraving do not infringe on any third-party intellectual property rights. 

8.2 Customers are responsible for obtaining necessary permissions or licenses for copyrighted or trademarked content. 

8.3 We reserve the right to refuse orders involving content we believe may infringe on intellectual property rights. 

8.4 Any designs created by us remain our intellectual property unless otherwise agreed in writing.

9. Liability

9.1 Our liability is limited to the cost of the order. We are not responsible for indirect, incidental, or consequential damages, including but not limited to loss of profits or emotional distress. 

9.2 We are not liable for damage to customer-supplied materials unless caused by our gross negligence. 

9.3 Customers assume all risks associated with the use of engraved products.

10. Warranty

10.1 We warrant that our products will be free from defects in workmanship under normal use for 30 days from the date of delivery. 

10.2 This warranty does not cover damage caused by misuse, improper care, or normal wear and tear. 

10.3 Our sole obligation under this warranty is to repair or replace the defective product at our discretion.

11. Customer-Supplied Materials

11.1 Customers may provide materials for engraving at their own risk. We are not responsible for damage to customer-supplied materials unless caused by our gross negligence. 

11.2 We reserve the right to reject materials deemed unsuitable for engraving.

12. Force Majeure

12.1 We are not liable for delays or failure to perform due to circumstances beyond our control, including but not limited to natural disasters, equipment failure, or supply chain disruptions.

13. Privacy

13.1 We collect and store personal information as necessary to process orders and provide services. Please refer to our Privacy Policy for details on how we handle your data. 

13.2 We will not share your personal information with third parties except as required to fulfill your order (e.g., shipping carriers) or as required by law.

14. Governing Law

14.1 These Terms and Conditions are governed by the laws of the State of Tennessee. 

14.2 Any disputes arising from these Terms will be resolved in the courts of White House, Tennessee.

16. Entire Agreement
